Summary:

Current state law sets a workday as eight hours and requires that overtime be paid for any additional work hours in a day or more than 40 hours in a week, unless two-thirds of workers in a unit adopt an alternate schedule of workdays lasting up to ten hours.

This bill allows any individual nonexempt worker to request to work a flexible schedule of up to ten hours in a day (totaling no more than 40 hours in a week) before being paid overtime.

Employers would be able to implement this schedule without any obligation to pay overtime.
