ACLU of Kansas and Western Missouri v. Praeger

Challenge to a Kansas law that prohibits insurance coverage of abortion and abortion-related services. In September, 2011, the U.S. District Court denied a motion for preliminary injunction. In March 2012, the court denied a motion to dismiss and allowed the lawsuit to go forward. Current Status: In January 2013, the court ruled in favor of the state that the law was not enacted for the illegitimate purpose of infringing on a woman’s right to abortion. The court further ruled that a trial was necessary to determine if the law constituted an undue burden on a woman’s right to abortion. Later that month, the ACLU dropped its challenge to the law.
