Summary: Women in Montana have greater access to pregnancy leave under state law than under federal law. Montana women workers are entitled to “a reasonable leave of absence for the pregnancy” with job protection. The law applies to businesses of any size and protects workers regardless of tenure and number of hours worked. However, because the Montana law is a maternity leave statute, male workers do not have family leave rights that exceed those provided under the FMLA.
