Pregnancy Leave
State: Montana
Subject: Pregnancy Disability Leave, Job-Protected Leave
Statute/Code Cite:
Mont. Code Ch. 49, Sec.2-310 et seq; Mont. Code Ann. Secs. 49-2-101(10)-(11)
Summary:
Women in Montana have greater access to pregnancy leave under state law than under
federal law. Montana women workers are entitled to “a reasonable leave of absence for
the pregnancy” with job protection. The law applies to businesses of any size and
protects workers regardless of tenure and number of hours worked.
However, because the Montana law is a maternity leave statute, male workers do not have family leave
rights that exceed those provided under the FMLA.
This database provides short summaries of bills and statutes. The summaries are not intended to constitute legal advice. To find out how laws relate to your particular situation, you must contact a lawyer who specializes in employees’ rights, the Labor Department’s Wage and Hour Division (1-866-4USWAGE), your state labor department and/or your union.
