Maternity Leave
State: Massachusetts
Subject: Pregnancy Disability Leave, Job-Protected Leave
Statute/Code Cite: Mass. Gen. Laws ch. 149, Sec. 105D; ch. 151B, Sec. 1(5).
Summary:
Women workers in Massachusetts have greater access to maternity leave (defined here
as leave for giving birth or leave to care for an adopted child) than under federal law.
Under the Massachusetts leave law, women workers with three months’ tenure who are
employed by businesses with six or more employees are entitled to up to eight weeks of
job-protected leave. However, because the law is a maternity leave statute, male workers
do not have greater parental leave rights than under federal law.
